This is the Privacy Policy for Blue Planet Training, Inc., DBA LifeHikes, Own The Room, and their respective affiliates (collectively, “LifeHikes”). It describes how we collect and use information when you visit lifehikes.com or our other website(s) (the “Website”); subscribe to our newsletter or blog; use our online platform or mobile application; receive or participate in professional training, conference support, open enrollment, content creation, facilitation, or other Professional Services (collectively, our “Professional Services”); or communicate with us online or offline (collectively, our “Services”). This Privacy Policy DOES NOT apply to any websites or platforms not owned or operated by LifeHikes, such as a Client’s or other third party’s website or platform, even if accessible from our Services.

This Privacy Policy is governed by and part of our Terms of Use. Any terms used in this Privacy Policy not defined herein are defined as provided in the Terms of Use. Any additional notices we may provide to you about our privacy practices will be considered to form part of this Privacy Policy.

Please read this Privacy Policy carefully to understand our privacy practices. If you do not agree with this Privacy Policy, you must not access or use our Services. Please contact us at privacy@lifehikes.com or via our Contact Us page if you have any questions, complaints or suggestions about this Privacy Policy.

1. PERSONAL INFORMATION

As used in this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual consumer or household. To give you a sense of scope, below are examples of categories of information that is legally protected as Personal Information:

  • Identifiers (e.g., name, email, telephone number, address, username);
  • Sensitive Personal Information (e.g., government identification number; precise geolocation; racial or ethnic origin; religious beliefs; health data; contents of messages when we are not the recipient; in some cases, information about a known child);
  • Legally protected information (e.g., race, citizenship, marital status, sex);
  • Employment-related information (e.g., current or past employment);
  • Non-public educational information, including information protected under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99);
  • Biometrics (e.g., DNA, face/voice prints, health data) and audio, electronic, visual, thermal, or olfactory information;
  • Commercial information (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);
  • Internet or other similar activity (e.g., browsing history; content interactions); and
  • Inferences drawn from Personal Information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes.

The above list is for example purposes only. LifeHikes limits its collection of Personal Information to what is necessary to provide the Services. LifeHikes does not collect all of the above categories of Personal Information. Also, not all information about you is legally protected as Personal Information. Depending on where you live, publicly available information, aggregated information (meaning data summaries or reports with Personal Information removed), employment-related information, or anonymized information (that cannot be linked back to you as an individual) may not qualify as “Personal Information.”

2. CLIENTS AND TEAM MEMBERS

Clients that have contracted with LifeHikes to receive our Professional Services (“Clients”) and their employees, contractors, agents, participants, and other end users of Client (“Team Members”) use the Services on a business-to-business basis. Each Client determines how it will use the Services and which Team Members will take part in the Services. LifeHikes only collects Personal Information about Team Members as a service provider to the Client and subject to the Client’s practices and policies. The Client is responsible for its own privacy practices, including how Personal Information about its Team Members is processed by and through the Services. The Client is responsible for giving Team Members adequate notice of the Services and obtaining Team Members’ consent for their participation in the Services and any processing of the Team Members’ Personal Information that may occur by or through the Services. Team Members should contact the Client with any questions about their Personal Information related to the Services.

3. LIFEHIKES’ PROCESSING OF PERSONAL INFORMATION

The Personal Information we collect about you and the manner of collection depends on how you interact with the Services. When you submit Personal Information to LifeHikes for us to process directly, we process that Personal Information as a controller. If we process Personal Information on behalf of our Clients, we do so as a service provider or processor to that Client. In all cases, LifeHikes limits the collection, use, disclosure, and retention of Personal Information to what is necessary to accomplish the purposes described in this Privacy Policy, or notified at the time of collection, or as authorized by you directly or through the Client.

1. Categories of Personal Information Collected

LifeHikes only collects and processes your Personal Information: (i) with your consent as informed by this Privacy Policy and freely given at the time you provide the information; (ii) to perform our contractual obligations to a Client; (iii) with a legitimate interest; or (iv) as authorized or required by law. During the preceding 12 months, LifeHikes has collected these categories of Personal Information:

  • Identifiers;
  • Employment information;
  • Internet or other similar activity; and
  • Other categories when instructed as a service provider to a Client.

We will notify you before we collect additional categories of Personal Information or use your Personal Information for purposes that are incompatible with the purpose stated at the time of collection.

2. Collection and Use of Personal Information

LifeHikes will only collect, use, retain, and disclose Personal Information as described in this Privacy Policy, and only as reasonably necessary and proportionate to provide the Services or for other purposes stated in this Privacy Policy or at the time of collection. LifeHikes collects Personal Information from these sources:

  • Account Registration. If you register to use our online portal or create an account on our mobile application, you will submit your name, email address, username, and password when prompted. You may also have the option to submit your username, gender, date of birth, company, title, physical address, and/or a short biographical statement. We collect this information with your consent, and we use it to provide your account and your access to selected platform and other Services.
  • Event Registration. When you register to attend the LifeHikes Global Summit or another event we host or sponsor, we collect your name, job title, company name, email address, phone number and other information necessary to provide you with access to the event. We may also use this information to communicate with you about our Services.
  • Provided By Clients. When we provide Professional Services to a Client, LifeHikes sometimes receives Personal Information from the Client about the Client’s Team Members (e.g., contact information, employment information, or other details). LifeHikes collects and uses this Personal Information as a service provider to the Client and subject to the Client’s instructions.
  • From a Client’s End User or Participant. If instructed by a Client, LifeHikes will provide Professional Services to one or more of the Client’s Team Members. This may include, for example, access to the online portal or mobile application, participation in surveys or analyses, or group or individual coaching, facilitation, or other sessions. In each case, LifeHikes will collect any information disclosed by the Client or its end user(s) or participant(s) during Professional Services sessions. We use this information to provide the contracted Professional Services. LifeHikes collects and uses this Personal Information as a service provider to the Client and subject to the Client’s instructions.
  • When you contact LifeHikes. If you contact LifeHikes online, by email, or other means, we will collect your name, email address and other necessary information to respond to your inquiry. We collect this information with your consent, and we use it for the purposes stated at the time of collection, to provide you with our Services, to provide you with technical or customer support, to communicate with you, or market to you according to your stated preferences. You can unsubscribe from our mailing list at any time using the “UNSUBSCRIBE” link we include in marketing messages.
  • Artificial Intelligence, as a service provider to the Client. LifeHikes may use artificial intelligence technology (“AI”) to process data input to the Services by the Client and its end user or participant, including data collected during Professional Services sessions. LifeHikes uses AI to provide AI-generated outputs to enhance the quality of our Services. Any use of AI-generated outputs by the Client is subject to the Client’s privacy practices, not ours. LifeHikes has no liability for the use of any data or AI-generated output by a Client or any other party.
  • The AI tools we use are provided by third party service providers. YOUR INFORMATION MAY BE ACCESSIBLE TO LIFEHIKES OR OUR THIRD-PARTY SERVICE PROVIDERS SIMULTANEOUSLY AND IN REAL TIME. By participating in Professional Services sessions or otherwise using our Services, you consent to this access to your information by LifeHikes and our AI service providers. If you do not consent to such access, you must arrange with the Client to prevent your Personal Information from being collected by LifeHikes for this purpose. LifeHikes may also use data input to AI tools for our legitimate interest of performing analytics on our Services, training and improving our AI tools, or to improve the Services. By participating in a session or otherwise using our Services, you consent to LifeHikes processing your Personal Information using AI tools.
  • Automatically when you use our Services, with a legitimate interest. When you visit the Website or use our online portal or mobile application, we collect technical data about your device and session (e.g., IP address, browser type, generalized geolocation, language, session connection and disconnection time, bandwidth and referring URL) to provide you with technical support and to analyze and improve our Services.
  • Cookies and Related Technologies. LifeHikes uses cookies and related technologies to collect technical data related to your use of the Services. Please see the cookie consent banner on the Website for details about the types of cookies and related technologies used on the website and your options to control how those technologies interact with your device. You can use the cookie consent banner to opt-out of non-essential cookies by clicking “Reject All” or you can click “Customize” to adjust specific settings for how cookies and related technologies interact with your device.
  • No Payment Processing. LifeHikes will not collect, store, or process payment information without your permission. We use a secure third-party payment processor to collect, process, and store payment information, subject to the payment processor’s policies and terms.
  • No Children’s Personal Information. The Services are designed for use by adults, not children. If we discover that a child under 18 has provided LifeHikes with their Personal Information, we will delete their information from our systems. If you believe we might have any information collected online from a child under 18, or if you become aware of any unauthorized submission of information to us, please contact us at privacy@lifehikes.com.
  • If a Client permits a child to provide Personal Information through the Services, that Client does so according to its own privacy practices, not ours. Please contact the Client with any questions about children’s privacy.
  • Other Uses of Personal Information. In addition to the specific uses described above, we may use Personal Information to (a) provide, administer, maintain, improve, or analyze the Services; (b) communicate with our Clients or others; (c) develop new services, products, or features; (d) prevent fraud, criminal activity, or misuse of our Services, or protect the security of our information systems; (e) comply with legal obligations or protect our rights and the rights of others; or (f) support or carry out a business transition or transfer.

4. RETENTION OF PERSONAL INFORMATION

LifeHikes’ policy is to retain Personal Information only as long as necessary to fulfill the purposes for which it was collected. For example:

  • Personal Information associated with your registration or portal account is retained while your account remains in active status.
  • Video presentations, performance reports, and course materials are retained while your account remains in active status.
  • Personal Information collected during personalized coaching sessions or other Professional Services is retained on the respective application or system for the duration of the Client agreement term.
  • We do not automatically delete LifeHikes accounts due to inactivity. Inactive accounts will be securely stored and protected, and you can reactivate your account at any time by logging in.
  • Data collected through cookies may be retained for a few minutes or for several months, depending on the cookie’s purpose and functionality.
  • Correspondence and support requests will be retained while your account is active and is deleted when we no longer require the data for our internal business purposes.

Personal Information will be deleted when we no longer require it for the purpose of its collection or within 14 business days of your written request for deletion, whichever occurs first. We may also retain Personal Information for other purposes that are compatible with the original purpose of collection or as informed by our company retention policies. LifeHikes reserves the right to also retain and use Personal Information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

5. DISCLOSURES OF PERSONAL INFORMATION TO THIRD PARTIES

1) Categories of Disclosed Personal Information

LifeHikes will only disclose your Personal Information with your permission, as described in this section, or as required by law. In the preceding 12 months, LifeHikes has disclosed Personal Information we collected through the Services to third parties for one or more business purposes as detailed in paragraph b below. We will not disclose Personal Information to third parties except as described in this section or with your consent. LifeHikes will be responsible for all onward transfers of Personal Information to our subcontractors and other disclosure recipients.

2. Recipients of Disclosed Personal Information

Personal Information may be disclosed to the following recipients:

  • Our Clients. When providing our Professional Services to a Client, we process Personal Information about the Client’s Team Members as a service provider to that Client. Personal Information related to a Client and its Team Members is processed for the benefit of that Client and is available to the Client. Clients use this Personal Information according to their own privacy practices. LifeHikes does not control and is not responsible for the privacy practices of our Clients. Team Members should direct any questions about their Personal Information and the Professional Services to the Client.
  • Your Selected Recipients. Some of our Services allow you to share reports, performance data, or other information with others through links, email, direct message, Airdrop, or other methods. Please be aware that any shared link or file may be further forwarded, redistributed, or accessed by others beyond your intended recipients. Once shared, LifeHikes cannot control or restrict such onward sharing by third parties. By choosing to use a sharing feature, you acknowledge that you are responsible for the recipients you share your information with, and you should only share with trusted individuals. LifeHikes is not responsible for disclosure or access resulting from onward sharing by recipients outside LifeHikes’ control.
  • AI Service Providers. LifeHikes uses third-party AI service providers to provide certain aspects of the Services. We may transfer certain data to these third-party AI service providers simultaneously and in real time. We will only process Personal Information through an AI service provider to provide Professional Services to a Client or for internal operations purposes. BY PARTICIPATING IN A SESSION OR OTHERWISE USING THE SERVICES, YOU CONSENT TO DISCLOSURE OF YOUR INFORMATION TO OUR THIRD-PARTY AI SERVICE PROVIDERS, AND YOU WAIVE ANY POTENTIAL EAVESDROPPING OR WIRETAPPING CLAIMS.
  • Our Service Providers. LifeHikes engages certain third-party service providers (e.g., cloud service providers, data hosting services, email management, analytics services). These service providers may have access to Personal Information as necessary to perform their contractual obligations to LifeHikes. Where possible, LifeHikes hosts or processes data within environments and accounts owned and controlled by our company. We contractually prohibit all service providers from selling or sharing this Personal Information, and we require all service providers to maintain confidentiality standards and appropriate technical and organizational measures to ensure the security of your Personal Information. A list of our current service providers is available upon request by emailing privacy@lifehikes.com.
  • Affiliates and Other Third Parties. LifeHikes may disclose the Personal Information we collect to our business affiliates or subsidiaries. Their use and disclosure of your Personal Information will be subject to this Privacy Policy. Additionally, under some circumstances we may disclose Personal Information we collect as permitted by applicable law, for example: if we go through a business transition (e.g., merger, acquisition, or sale of a portion of our assets); to comply with a legal requirement or a court order; when we believe it is appropriate in order to take action regarding illegal activities or prevent fraud or harm to any person; to exercise or defend our legal claims; or for any other reason with your consent.
  • Law enforcement, and other government agencies. In some rare cases, LifeHikes may be required to disclose, and may disclose, Personal Information in response to lawful requests by public authorities. It is our policy in these cases to only disclose Personal Information when and to the extent required to comply with applicable law.
  • Aggregated and Deidentified Information. We reserve the right to disclose aggregated, anonymized, or de-identified information about any individuals with nonaffiliated entities for marketing, advertising, research or other purposes, without restriction.

6. PRIVACY CONTROLS AND LEGAL RIGHTS

1) Your Options to Control Your Personal Information

LifeHikes gives you the ability to directly control the Personal Information we collect and hold about you through our Services:

  • Your Portal Account. If your use of the Services includes access to our online portal, you can access, correct, and update certain Personal Information on your account by logging in and saving their changes or adjusting settings. If you require assistance or want to revoke a consent you previously gave us, please contact privacy@lifehikes.com.
  • Professional Services. LifeHikes provides professional training, conference support, open enrollment, content creation, facilitation, and other Professional Services on a business-to-business basis to our Clients. The Client is solely responsible for any processing of their Team Members’ Personal Information through the Professional Services. Please direct any privacy questions about the Professional Services to the Client.
  • Reminder Emails and Text Messages. We may send you informational or support emails related to your use of our Services. For example, you may receive reminders about an upcoming training or event. You can unsubscribe from these reminder emails anytime. You are responsible for your own Course completion and progress tracking, whether or not you receive these reminder messages from us.
  • Text Message Consent and Opt-Out. If you provide us with your wireless number, you consent to LifeHikes sending you text messages for informational or authentication purposes. If you opt-in to our marketing texts, we will also use your wireless number to send you texts about offers, promotions, or ads. The number of texts that we send to you will be based on your circumstances and requests. You can unsubscribe from text messages by replying STOP or UNSUBSCRIBE to any of the text messages we send to you. Messaging and data charges may apply to any text message you receive or send. Please contact your wireless carrier if you have questions about messaging or data charges.
  • Marketing Emails. Depending on your communication preferences, we may also send you marketing emails. If you do not wish to receive marketing emails from us, you can unsubscribe or change your preferences via the links provided in the emails or send a request to privacy@lifehikes.com to be removed from our email list. If you opt out of our marketing communications, we may still send you non-promotional communications related to your use of our Services.
  • Device Settings. You can control how we automatically collect certain data by adjusting your device settings.
  • Do Not Track. Do Not Track signals are signals sent through a browser informing the website operator that the user does not want to be tracked. Currently, LifeHikes systems do not recognize browser “do-not-track” requests.
  • Privacy Requests. Depending on where you reside, you may be entitled to additional controls over your Personal Information. Read more about privacy rights that may be available to you under “Notice of Privacy Rights” below. If you wish to exercise your privacy rights beyond the methods described above, or if you want to express concerns, lodge a complaint, or request information, please submit a verifiable Privacy Request by email to privacy@lifehikes.com.

LifeHikes may only legally fulfill a Privacy Request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so, such as requests that are excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting privacy@lifehikes.com.

If LifeHikes collects or processes your Personal Information as a service provider to one of our Clients, we will relay your request to the Client for processing. We will cooperate with the Client’s instructions to honor your requests and privacy choices.

2. Notice of Privacy Rights

This section provides informational notices pursuant to consumer privacy laws that require companies to inform consumers about their privacy rights, such as the European Union’s General Data Protection Regulations and its counterpart in the United Kingdom, U.S. privacy laws such as the California Consumer Privacy Act and other state laws providing privacy rights to consumers, and Canada’s Personal Information Protection and Electronic Documents Act and Québec’s provincial privacy law. Some or all the protections afforded under these laws may not apply to LifeHikes or your use of our Services. Depending on where you live, your rights over your Personal Information may include some or all of the following:

  • Right to Know. You have the right to know how we collect and process your Personal Information. We have set the required notices in this Privacy Policy. We may provide you with additional notices about other ways we process your Personal Information, such as by sending you a notice via email or by other means of communication.
  • Right to Expect. You can expect us to collect, use or disclose your Personal Information responsibly and not for any purpose other than which you consented. We set your expectations in this Privacy Policy, and we collect legally required consent at various stages of our interactions with you. If we collect or use your Personal Information based on your consent, we will also notify you of any changes and will request your further consent as required by law. You may withdraw your consent at any time with reasonable notice by contacting privacy@lifehikes.com.
  • Right to Correct. You may have the right to the accuracy of your Personal Information and the right to request that we correct inaccurate Personal Information about you on our systems. If you become aware that the Personal Information that we hold about you is incorrect, or if your information changes, please inform us and we will update our records.
  • Right to Deletion. You may have the right to request that we delete or dispose of your Personal Information processed on our systems, with certain exceptions. LifeHikes may permanently delete, de-identify, or aggregate your Personal Information in response to a request for deletion. Deleting your Personal Information may make it impossible for LifeHikes to continue providing our Services to you.
  • Right to Access. You may request confirmation that we have collected Personal Information about you and that we provide you with access to that Personal Information. If you submit an access request, we will provide you with copies of the requested pieces of Personal Information in a portable and readily usable format. Please note that certain laws may prohibit LifeHikes from disclosing specific pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill.
  • Right to Data Portability. Upon your request we are sometimes required to provide your Personal Information to another organization at your request and in a structured, commonly used machine-readable format, so that the other organization can read and use it.
  • No Sale or Sharing. Some U.S. states entitle consumers to opt out of the sale or sharing of Personal Information or targeted advertising practices. LifeHikes does not sell your Personal Information or share your Personal Information with third parties for cross-contextual behavioral advertising purposes.
  • Limited Use and Disclosure of Sensitive Personal Information. LifeHikes does not seek to collect sensitive Personal Information from any individual. In no case will LifeHikes use or disclose any sensitive Personal Information for the purpose of inferring characteristics about the consumer.
  • No Automated Decision-Making or Profiling. You may have the right to opt out of automated decision-making or profiling. LifeHikes does not use any form of automated processing of Personal Information to evaluate, analyze, or predict your performance, preferences, choices, or behavior. But we have no control over whether our Clients use data collected through the Services in a manner that qualifies as ADM or profiling. Please contact the Client if you have questions about automated use of your Personal Information.
  • Right to Disclosure. You may request that we provide you with certain details about our collection and use of your Personal Information, such as: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for the Personal Information we have collected about you; (iii) categories of our team members who have access to your Personal Information and LifeHikes’s business purpose for collecting, using, processing, sharing or selling that Personal Information, as applicable; (iv) the categories of third parties with whom we share that Personal Information; and (v) if we sold or shared your Personal Information under certain privacy laws, two separate lists stating: (a) for sales or sharing, identifying the Personal Information categories that each category of recipient purchased; and (b) for disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.
  • Right to Object. You may have the right to request, under certain circumstances and where we are required to do so by law, that we limit our processing of your Personal Information as you request.
  • Right to Restrict. You may have the right to request that we restrict the processing of your Personal Information if (i) the data is inaccurate, (ii) the processing is unlawful, (iii) we no longer need the Personal Information, or (iv) you exercise your right to object. Your right to restrict may be limited to Personal Information that is sensitive in nature, or that is sold or shared for certain purposes.
  • Health Data Rights. Our Services are not designed for collection of processing of health data. Please do not submit any health data through the Services. Some laws entitle consumers to certain details about health data collected about them, including (i) confirmation of whether the entity collects, shares, or sells the consumer’s health data and access that data, including a list of all third parties and affiliates with whom the entity has shared or sold the health data and a method to contact those third parties, (ii) a method to withdraw consent related to use of health data, and (iii) the right to have their health data be deleted.
  • Right to Nondiscrimination. LifeHikes will not discriminate against you for exercising your privacy rights. For example, unless permitted by law, we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised a right under applicable privacy laws.
  • Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to receive certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes upon request.

To exercise your rights or ask questions, please contact privacy@lifehikes.com. LifeHikes will support your exercise of privacy rights to the extent a consumer privacy law applies to your use of our Services, subject to statutory exceptions and limitations. In cases where your request must be submitted to the applicable Client, we will instruct you to do so.

7. DATA SECURITY

LifeHikes takes our privacy obligations seriously. We are committed to safeguarding the Personal Information entrusted to us. We have implemented and maintained reasonable and appropriate security measures to help protect Personal Information in our possession from unauthorized access, processing, alteration, or disclosure. We use a combination of technical and organizational measures, procedures, and standards to govern Personal Information processing and safeguard the data in our possession. For example, we implement access controls, use firewalls, secure servers and encrypt certain types of data, such as financial information and other sensitive data. Only trained and authorized LifeHikes personnel may access Personal Information, and only when necessary for a specific business reason. Only authorized service providers may process Personal Information and only when necessary for s specific business reason. Employees and/or contractors who violate our policies are subject to disciplinary action, up to and including termination. Our security measures are designed to meet our duty of care related to your Personal Information. Please note, however, that no transmission of data over the Internet is 100% secure, and we cannot guarantee that unauthorized third parties will not defeat our security measures or use your Personal Information for improper purposes.

You are encouraged to take steps to protect against unauthorized access to your password, links or other access mechanism to Courses you select, and your device(s) by choosing a robust password that nobody else knows or can easily guess, keeping your password and links private, and signing off after using a shared device. LifeHikes is not responsible for any lost, stolen, or compromised passwords, or for any unauthorized activity using your login credentials or any link.

8. CONSENT TO CROSS-BORDER DATA TRANSFERS

LifeHikes is owned and operated in the United States. When transferring Personal Information across jurisdictional borders, we take measures to comply with applicable data protection laws related to such transfer. When your information is moved from your home country to another country, the laws and rules that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is transferred to the United States, it may be accessed by government authorities under United States law.
